Eclipse Tower Presale Buyers Sue Thind to Void Their Contracts

Dozens of pre-sale purchasers at Thind Properties' troubled Eclipse tower have filed BC Supreme Court applications claiming their contracts are unenforceable and demanding their deposits back. The applications allege the developer breached BC's Real Estate Development Marketing Act by failing to disclose material facts, including a $12 million CRA judgment against the developer dating back to June 2023 and the suspension of warranty coverage in October 2024. Buyers argue they would never have signed if they had known.


BC Court Tells Presale Buyers: You Can't Just Walk Away

In a decision released May 22, the BC Supreme Court ruled in Rhythm Living Ltd. v. Pereira, 2026 BCSC 555 that presale purchasers cannot easily refuse to close on a unit simply because negotiated extras remain unfinished or new concerns emerge shortly before completion. The ruling matters because it sets a higher bar for buyers trying to escape contracts in a softening market. With condo prices down and inventory at record highs, expect more developers to lean on this precedent when chasing failed completions.


PM Carney Signals Federal Deal Coming to Cut BC New-Build Costs

Prime Minister Mark Carney told the Greater Vancouver Board of Trade on May 20 that an HST harmonization and development cost charge deal for British Columbia, similar to the one already in place for Ontario, is "in early stages of discussion." UDI, BCREA, and several industry organizations responded with a letter to Housing Minister Christine Boyle calling for faster action. If it lands, the deal could meaningfully reduce the cost of new construction across the province, which directly affects every presale price tag in BC.
